Statement by the Foreign Ministry of the Russian Federation on actions of

American internet monopolies

We support the Statement by the Federation Council of the Federal Assembly of the

Russian Federation in connection with the violation of the principle of ffeedom of speech by

global American Internet companies.

The restrictive actions taken by the administration of American social media giants

with regard to the content posted on their platforms have delivered a blow to the democratie

system of values and the international information architecture.

The permissibility of arbitrary, without a court decision, and non-transparent

censorship of media content by digital platforms puts in question the role of the State as the

guarantor of compliance with international obligations on the freedom of expression by

subjects under its jurisdiction.

This is a violation of the International Covenant on Civil and Political Rights, the

Helsinki Final Act and other OSCE documents, which the United States signed.

This precedent shows that American IT giants are free to formulate the image of the

communication infrastructure in the interests of their corporations and their curators, in

complete disregard of the fundamental democratie and ethical norms.

Therefore, the international community is facing the challenge of ungovemable

information space and the exposure of personal data aceumulated by social media.

We have taken note of a large number of fake news about Russia posted by American

digital platforms that systemically produce provocational content, which is, in tum,

coordinated by the US Embassy in Moscow. On January 27, a US Embassy official was

summoned to the Foreign Ministry of Russia, where he was handed a note of protest

containing a waming that Russia reserves the right to take reciprocal action.

Discussions on the risks posed by American IT media giants’ monopoly to the

freedom of communication and human rights have been ongoing at relevant international

platform for years. However, any attempts to reinforce the regulation of social media have

been hindered by our Western colleagues who interpret such proposals as an infringement on

the freedom of speech.

It is obvious that the media sphere must be regulated and codified. Constructive

dialogue must be established with all the interested parties for stimulating efforts to work out

explicit requirements for transparent standards of social media content moderation and to

formalise them in international documents.

There is pressing need for launching joint substantive efforts towards this end at

relevant international organisations, first of all the UN, the Council of Europe and the OSCE.

STATEMENT OF THE FEDERATION COUNCIL

OF THE FEDERAL ASSEMBLY OF THE RUS SI AN FEDERATION

in connection with violation of the principle of freedom of speech

by global American Internet companies

The Federation Council of the Federal Assembly of the Russian

Federation strongly condemns actions of global American Internet companies

that, for political reasons, without legal grounds and contrary to the norms

of international law, restrict freedom of speech in social networks

of the information and telecommunication network «Intemet».

Developments of events after the presidential elections in the United

States of America showed that the American Internet giants opted for

widespread use of censorship, contrary to the principles of democracy,

the universally recognized right of citizens to search, receive and disseminate

information, as well as illegal blocking of alternative platforms. In the context

of the subordination of social networks to the political agendas of the ruling

circles of the United States of America, there is a threat of imposing on their

users a one-sided, prejudiced view of what is happening not only in this

country, but throughout the world.

It is particularly dangerous that restrictions on freedom of speech are not

imposed in accordance with the law, but by the decision of the heads

of Internet companies, are arbitrary and do not have a legal basis. Thus, outside

the legislative framework, access to information is restricted to hundreds

of millions of users of the information and telecommunication network

«Intemet», who are deprived of the right to freely express opinions that do not

contradict the law.

It should be especially emphasized that it is about monopoly control over

the global network by Internet companies representing one country - the United

States of America and closely related to its State structures, which is fraught

with the assertion of the dominance of one State over most of the global network

exchanges.

The illegal decisions of the leaders of the US social networks have once

again confirmed that the usurpation of control over the Internet is not a fictional

threat, but already a reality. Such control is a powerful weapon that is used not

only to violate civil liberties and ffeedom of speech directly in the United States

of America, but may also be directed against other countries, including with the

aim of influencing public sentiment, provoking intemal political crises,

influencing the will of citizens and the outcome of elections.

Senators of the Russian Federation consider being unacceptable the

position of American Internet companies, which severely censor unfavourable

political opinions, while failing to fulfill their obligations to combat the

dissemination of inaccurate information, including actively encouraging

Russian citizens to take part in unauthorized protests in the light of high risk of

new coronavirus infection. Despite the faet that false information has been

officially rejected on se veral occasions, heads of these companies deliberately

refrain from removing or blocking this content.

In these context, the Federation Council of the Federal Assembly

of the Russian Federation draws the attention of the legislative bodies of all

States of the world to the urgency and necessity of developing national

legislation to limit the power and arbitrariness of global Internet companies.

The individual decisions of their executives must not be allowed to replace the

laws of sovereign States.

The regulation of the activities of Internet companies in the area of its

jurisdiction is the legitimate and integral right of every State to protect the

information space, the right of citizens to freely receive and disseminate

information. For Russia, such regulation, along with the development of its own

social networks and Internet platforms, is an important and necessary part

of ensuring national digital sovereignty.

The Federation Council of the Federal Assembly of the Russian

Federation calls on the Secretary General of the United Nations, the Director

General of the United Nations Educational, Scientific and Cultural Organization

(UNESCO), the specialized monitoring mechanisms of the United Nations

Human Rights Council, the Secretary General of the Council of Europe,

the Chairman-in-Office of the Organization for Security and Cooperation in

Europe, the Representative of the Organization for Security and Cooperation in

Europe on Freedom of the Media, to prioritize the task of limiting the

arbitrariness of American global Internet companies in order to prevent the

threat of their establishment of a «digital dictatorship». This issue should also

become the subject of the most serious consideration at the meetings of the

United Nations General Assembly and its relevant Main Committees, the

Parliamentary Assembly of the Council of Europe and the Parliamentary

Assembly of the Organization for Security and Cooperation in Europe.

The recent threat of the uncontrolled dominance of global Internet

companies makes it imperative to initiate work on an international convention

regulating their activities. The aim of this work should be the development

of such generally accepted norms that will rule out arbitrary decisions and put

global Internet exchanges on the firm ground of international law,

The World Wide Web should remain a space of freedom of speech and

freedom of information, regulated by law, and not an instrument of the policy

of one State and closely related media monopolies.
