Thank you for your inquiry regarding professor of business and politics, Dr. Brooke
Harrington. Since questions regarding non EU/EEA foreigners working in Denmark
are under my realm of authority the Prime Minister has asked me to take care of
the response.
I certainly do agree that the current regulation presents a lot of difficulties to pro-
fessionals who regularly as part of their profession have exterior activities. To
solve the problem the Danish government has recently introduced a proposition
to the Danish Parliament giving holders of work and residence permits a more
flexible right to undertake sideline employment without having to apply for it. The
final vote in parliament is planned to take place on May 8
th
2018, and if the legis-
lation is passed according to the proposition then, in future, there shouldn’t be
any further barriers to sideline employment.
Up until now, according to Danish law, a work and residence permit allows you to
work only at the one specific employment that has been applied for. Any sideline
employment requires additional application and permit. If you without a sideline
permit take a job at a different employer, then you are, regardless of payment
and quantity, working illegally and you put yourself at risk of criminal charges.
This regulation, obviously, does not fit well with the activities of highly skilled for-
eign professionals, but I must point out that there has been no new interpretation
of the regulation. The necessity of additional permit for sidelining has been part of
the legislation for a very long time.
Regarding criminal charges, I can inform you that punishment in cases that ha-
ven’t reached their conclusion on the date of the new law’s entry into force will
be subdued to the guidelines of the new legislation. That is, if the new legislation
puts the person in a better position.
