KENYA NATIONAL ASSEMBLY
DEPARTMENTAL COMMITTEE
ON EDUCATION, RESEARCH AND
TECHNOLOGY
Background
The subjects falling within the
purview of the Departmental
Committee on Educatiion, Research
and Technology are:-
Education,
Research,
Training, and
Technological advancement.
The Committee is mandated, among
others, to:-
i)
investigate, inquire into,
and report on all matters
relating to the mandate,
management,
activities,
administration, operations
and estimates of the
assigned Ministries and
departments;
ii)
study the programme and
policy
objectives
of
Ministries and departments
and the effectiveness of the
implementation;
iii)
study and review all
legislation referred to it;
iv)
study, assess and analyze
the relative success of the
Ministries and Departments
as measured by the results
obtained as compared with
their stated objectives;
v)
investigate and inquire into
all matters relating to the
assigned Ministries and
departments as they may
deem necessary, and as may
be referred to them by the
House;
vi)
vet and report on all
appointments where the
Constitution or any law
requires the National
Assembly to approve,
except those under
Standing Order 204
(
Committee on
Appointments
);
vii)

x)
examine treaties,
agreements and
conventions;
make reports and
recommendations to the
House as often as possible,
including recommendation
of proposed legislation;
consider reports of
Commissions and
Independent Offices
submitted to the House
pursuant to the provisions
of Article 254 of the
Constitution; and
examine any questions
raised by Members on a
matter within its mandate
Execution of the Committee Mandate
The Committee chooses its own
subjects of inquiry and seeks evidence
from a wide range of individuals
depending on the matter under
scrutiny whereby witnesses give oral
or written evidence. The Committee
compiles reports which are adopted by
the House before the relevant
Ministries
and
Departments
implement the
recommendations
contained therein.
All Committee proceedings are open to
the public except where the
Committee makes an exception and
when the committee is considering its
recommendations for purposes of
compiling its reports. The public must
adhere to laid down rules on access to
Committee meetings.
Committee Mandate

Committal of Bills to the Committee
(S.O. 127)
After the First Reading, bills are
committed
to
the
relevant
Departmental Committees. This does
not apply in the case of a Consolidated
Fund Bill, an Appropriation Bill, a
Supplementary Bill, or a Finance Bill
which shall be committed to the
budget and Appropriation Committee.
The Committee must present its report
to the House within twenty (20)
calendar days of such committal or
report progress at the commencement
of 2

Reading
(S.0. 127) and failure to present report
shall be noted by the Liaison
Committee S.O. 127(5) for necessary
action.
Committal of Annual Estimates to the
Committee (S.O. 235)
Upon being laid before the National
Assembly, the Annual Estimates from
the
assigned
Ministries
and
Departments stand committed to the
relevant Departmental Committee to
consider, discus and review the
Estimates before it submits its report to
the
Budget and
Appropriation
Committee within twenty-one days.
Approval of Public Appointments
(S.O. 45)
(1) Upon receipt of a notification of
nomination for appointment to a State
Office or such other office as is under
the Constitution or under any other
legislation required to be approved by
the House, the nomination shall stand
committed to the relevant
Departmental Committee of the House
for consideration.
(2) Despite paragraph (1),
appointments under Article 152(2) of
the Constitution shall stand committed
to the Committee on Appointments.
(3) Before holding an approval
hearing, a Committee to which
proposed appointments have been
referred to shall notify the candidate
and the public of the time and place
for the holding of the approval
hearing at least seven days prior to the
hearing.
(4) The Committee shall conduct a
hearing on the proposed appointment
and shall, unless otherwise provided in
law, table its report in the House
within fourteen days of the date on
which the notification was received
under paragraph (1).
Public Attendance to Committee
Meetings (S.0. 198)
(1) All committee proceedings shall be
open to the public unless in
exceptional circumstances the Speaker
has determined that there are
justifiable reasons for the exclusion of
the public.
(2) The Committee may adjourn to
seek leave of the Speaker to exclude
the public.
