The Danish government’s reply to the Commission’s Public Consultation on
the Database Directive
The Danish government supports the goal of the Commission to create a framework,
which is capable of supporting a well-functioning European data economy and
promoting the development of data driven business models as described in the
Commission’s
communication “Building
a European Data
Economy” (COM(2017)9
final).
Legislation related to, e.g. ownership of data, should be futureproof, so it does not create
unjustified barriers for the development and introduction of innovative data-driven
technologies. When it comes to access and reuse of data, it is the experience in Denmark
that the legislative framework is complex.
It is crucial that any forthcoming initiatives are based upon thorough analysis of
stakeholders’ input and considerations as well as experiences of stakeholders. The
Danish Government thus welcomes the public consultation on the Database Directive,
which will contribute to a better understanding of whether existing rules should be
modernized and streamlined with other legislation and proposals from the Commission.
Should the Commission find that changes are necessary; such changes should take into
account the interests of all relevant stakeholders
from data proprietors to new
innovative services to consumers. Due care should also be taken to existing acquis and
other proposals from the Commission in order to prevent overlapping legislation and
uncertainty with regard to the interplay between different rules.
