CAT Communication No. 580/2014
F.K. v. Denmark
Follow-up observations of the Government of Denmark
1.
Introduction
By letter of 22 December 2015, the Committee against Torture (hereinafter ‘the Committee’)
transmitted its decision adopted on 23 November 2015 in the above case to the Government
of Denmark (hereinafter ‘the Government’).
In para. 9 of the Committee’s decision, the Government was invited to inform the Committee,
within 90 days, of the steps taken in response to the Committee’s observations.

The Government’s follow-up observations
2.1 Article 3 of CAT
The Government observes that it follows from para. 7.6 of the Committee’s decision that the
Committee considers that,

As such, the Committee considers that,

of the Convention against Torture and other Cruel, Inhuman or
Degrading Treatment or Punishment (hereinafter ‘CAT’).
The Government would like to inform the Committee that on 9 January 2015 the complainant
requested the Refugee Appeals Board (Flygtningenævnet) to reopen his asylum case, referring
to the medical examination made by Amnesty International on 25 September 2014 (Annex 3).
It should be noted that the medical examination was referred to as an examination for signs of
torture in the decision made by the Refugee Appeals Board on 18 September 2015.
On 18 September 2015, the Refugee Appeals Board refused to reopen the complainant’s
asylum case. The following appears,
inter alia,
from the decision of the Refugee Appeals
Board:
‘The Refugee Appeals Board observes that the Board will not initiate an examination
for signs of torture in cases in which the Board has been unable to consider as facts the
