RESOLUTION
Of the Verkhovna Rada of Ukraine
On the Appeal of the Verkhovna Rada of Ukraine to the United Nations and
the national parliaments of the world on the establishment of an international
tribunal to prosecute those responsible for crimes related to the downing of
the Malaysia Airlines flight MH17 on 17 July 2014

The Verkhovna Rada of Ukraine
decrees:
1. To adopt the Appeal of the Verkhovna Rada of Ukraine to the United
Nations and the national parliaments of the world on the establishment of an
international tribunal to prosecute those responsible for crimes related to the
downing of the Malaysia Airlines flight MH17 on 17 of July 2014
(attached).
2. To entrust the Chairman of the Verkhovna Rada of Ukraine with an
immediate submission of the text of this Resolution to the United Nations
and the national parliaments of the world.
3. This Resolution enters into force on the day of its adoption.

THE APPEAL
Of the Verkhovna Rada of Ukraine to the United Nations and the national
parliaments of the world on the establishment of an international tribunal to
prosecute those responsible for crimes related to the downing of the Malaysia
Airlines flight MH17 on 17 July 2014
One year ago on 17 July 2014 the Malaysia Airlines flight MH17 was
downed over the territory of Ukraine in the Donetsk Oblast, which had been
occupied as a result of an armed aggression of the Russian Federation. 283
passengers and 15 crewmembers on board of the MH17 flight perished as a result
of this international crime.
The above-mentioned crime caused a considerable international outcry. In
particular, the UN Security Council adopted Resolution 2166 (2014) on 21 July
2014, in which it stressed the need for a full, thorough and independent
international investigation in accordance with international civil aviation
guidelines of the International Civil Aviation Organization (ICAO) and called on
all States and actors in the region to cooperate fully in relation to the civil and
criminal investigation and to bring to justice those responsible for this incident.
The preliminary findings, issued on 9 September 2014 by the Dutch Safety
Board, which is authorized to investigate the incident, showed that the aircraft was
damaged from outside by a large number of high-energy objects.
The Verkhovna Rada of Ukraine expresses its condolences to the families
and loved ones of the victims of this incident and fully supports the common
initiative of Ukraine, the Netherlands, Malaysia, Australia and Belgium, which
conduct an independent criminal investigation of the case into the downing of the
aircraft, to establish an international criminal tribunal by the UN Security Council
to prosecute those responsible for crimes connected with this incident.
The leadership of the Russian Federation has tried to derail the investigation
of this crime by all means and to misinform the international community. The
Russian Federation as an aggressor state, which annexed the Crimea, occupied a
part of the Donbas region and turned its servicemen into bloody terrorists, has
neither moral nor legal right to block the decision of the UN Security Council to
establish the aforesaid international tribunal.
The establishment of an international tribunal by the UN Security Council
under Chapter VII of the UN Charter is the best means of ensuring justice for the
victims and their loved ones and will be in line with the highest international
standards. It will constitute an adequate response to the tragedy by the UN since
the incident and related security implications for civil aviation affect the interests

of the international community as a whole, threaten international peace and
security and endanger civil aviation.
The Verkhovna Rada of Ukraine calls on all UN Member States:
To prevent impunity for perpetrators responsible for the downing of the
Malaysia Airlines flight and to ensure strict implementation of the principle of
inevitability of punishment;
To urge the Russian Federation to support the adoption of the UN Security
Council resolution on the establishment of an international criminal tribunal to
prosecute those responsible for this international crime;
To ensure appropriate cooperation with the tribunal’s organs upon its
establishment.
