The European Commission considers that the cabotage restrictions in force, the disparities in theimplementation of the rules on access to the profession of transport operator and the difficulties inapplying labour rules make the EU road haulage market inefficient. In order to overcome thesedifficulties, the Commission recommends gradually opening this market further on the basis of anumber of policy packages to liberalise cabotage.

Austria, Belgium, Denmark, France and Italy do not share this assessment and consider that it ispremature to initiate legislative developments, especially in respect of texts that have recentlyentered into force, if their objective leads to further opening of the road haulage market, which iscurrently plagued by serious irregularities.

widespread use within the sector of organisational methods based on non-compliancewith or circumvention of existing rules, particularly with regard to the requirement ofestablishment, in order to drag down the cost of transport services, which results in thecrowding out of law-abiding companies and their drivers.

In order to re-establish the conditions required for the smooth functioning of the market, effortsshould be focused on supplementing the existing rules concerning both access to the profession oftransport operator and access to the international market, in particular the introduction of cleardefinitions relating, inter alia, to the prior international transport operation as well as sociallegislation, by means of effective provisions that aim to restore equality between employees doingthe same work. This also requires the convergence of the national authorities' monitoring policies inorder to ensure that the authorities' practices are on the same level.

La Commission européenne a entamé en octobre 2012 un processus de consultation des partiesprenantes en vue d’amender la réglementation existante en matière d’accès au marché, notammenten ce qui concerne les règles du cabotage.

La Commission européenne estime que les restrictions en vigueur sur le cabotage, les disparitésdans la mise en œuvre de la réglementation sur l’accès à la profession de transporteur et lesdifficultés dans l’application de la réglementation en matière de travail rendent le marché dutransport routier de marchandises au sein de l’Union inefficace. Pour remédier à ces difficultés, ellepréconise une ouverture plus importante de ce marché sur la base d’une approche graduelle faisantappel à de multiples hypothèses (policy packages) de libéralisation du cabotage.L’Autriche, la Belgique, le Danemark, la France et l’Italie ne partagent pas cette analyse etconsidèrent qu’il est prématuré d’engager une évolution législative, s’agissant de textes par ailleursentrés récemment en application, si son objectif conduit à ouvrir davantage le marché du transportroutier de marchandises, aujourd’hui affecté par de graves dysfonctionnements.

une dégradation des conditions de concurrence résultant de la discrimination entreconducteurs, fondée sur leur nationalité, alors qu’ils effectuent le même travail au seind’un Etat membre ;la généralisation de modes d’organisation du secteur reposant sur le non respect ou lecontournement de la réglementation existante, notamment en matière d’exigenced’établissement, de manière à tirer les coûts des prestations de transport vers le bas, cequi entraîne l’éviction des entreprises respectueuses de la réglementation et de leursconducteurs.

Afin de restaurer les conditions d’un fonctionnement harmonieux du marché, il est préférabled’orienter les efforts en complétant la règlementation existante, aussi bien en matière d’accès à laprofession de transporteur que d’accès au marché international, s’agissant notamment del’introduction de définitions claires relatives, entre autres, à l’opération de transport internationalpréalable ainsi qu’en matière sociale, par des dispositions efficaces visant à rétablir l’égalité entretravailleurs effectuant le même travail. Ceci requiert en outre la convergence des politiques decontrôle déployées par les autorités nationales, afin de doter ces dernières d’un niveau de pratiqueshomogène.
