Your Excellency,
I beg to send you a reasoned opinion adopted by the Czech Senate plenary in
compliance with the Article 6 of the Protocol No. 2 of the Lisbon Treaty on September
22, 2010 on Proposal for a Directive of the European Parliament and of the Council on
the conditions of entry and residence of third-country nationals for the purposes of
seasonal employment.
With respect to the long-term position of the Czech Senate declared at various
interparliamentary events, be it the Conference of Speakers, COSAC or regional meetings,
I suppose that the fundamental prerequisite for responsible exercising of preliminary
subsidiarity check (early warning system) is an effective coordination and timely
information exchange between national parliaments.
Since the Lisbon Treaty entered into force, the above mentioned directive is the
first draft legislation act that has made both the Czech Government and our
parliamentary chamber resolve that its adoption is not necessary and that the appropriate
level of legal regulation might be set up by the member states individually according to
the needs of their respective labour markets.
I am delighted that several parliamentary chambers of the EU member states have
decided to examine whether the proposal is in compliance with the principle of
subsidiarity. We can ensure only by consistently carrying out the role of legislative bodies
that the provisions of the Lisbon Treaty devoted to the principle of subsidiarity assuming
the high quora for applying the mechanism of yellow or orange card will not remain just
empty letters.
Therefore I would like to recommend the above mentioned proposal of the
European Commission to your attention and I am looking forward to your reaction.
