DRAFT RESOLUTION
Combat Against Illicit Trade in Human Organs

1. Recalling Resolution 55/25 of the United Nations General Assembly of 15 November2000 adopting the Convention of the United Nations against Transnational OrganizedCrime, the Protocol on Protocol to Prevent, Suppress and Punish Trafficking inPersons, Especially Women and Children, supplementing the United NationsConvention against Transnational Organized Crime,2. Recalling also Resolution 59/156 of the United Nations General Assembly of 20December 2004 on Prevention, Combat against and Punishment Trafficking inHuman Organs,3. Supporting the efforts of the member states of ОSCE in the implementation of theAction Plan for Combating Human Trafficking (2003), as well as the principlesresulting from the documents adopted by OSCE PA concerning combat againsthuman trafficking,4. Taking into account also the conclusions of the joint study of the United Nations andthe Council of Europe from 2009 under the title ofTrafficking in Organs, Tissues andCells and Trafficking in Human Beings for the Purpose of the Removal of Organs,5. Recalling the Convention of the Council of Europe on Human Rights andBiomedicine of 4 April 1997 and the Additional Protocol to the Convention onHuman Rights and Biomedicine concerning transplantation of human organs andtissues of 24 January 2002,6. Further recalling Resolution 1782 (2011) of the Parliamentary Assembly of theCouncil of Europe – Investigation of Allegations of Inhuman Treatment of Peopleand Illicit Trafficking in Human Organs in Kosovo of 25 January 2011,7. Noting that human trafficking is one of the most severe crimes against humanity andtrafficking in human organs its most extreme form,8. Concerned by the negative economic and social implications of organized criminalactivities on living of people, as well as by the possible increase of this type of crime,in particular by the illicit trade in human organs,9. Especially concerned by the abduction and human trafficking for the purpose of theremoval of organs, in particular under the conditions of war conflicts,10. Also especially concerned by the abduction of civilians and war prisoners in Kosovoand Metohija during the war conflicts in 1999 and immediately afterwards,1
The OSCE Parliamentary Assembly:11. Condemns any activity aimed at illicit trade in human organs;12. Condemns most strongly the activities of organized criminal groups impairing in thisway human living, their integrity and fundamental human rights, especially in caseswhere abductions are ethnically, religiously, racially and politically motivated;13. Invites the member states of OSCE to combat determinedly organized criminalgroups dealing with illicit trade in human organs and human trafficking for thepurpose of the removal of organs;14. Recommends for this purpose to establish closer co-operation implying exchange ofinformation and more efficient actions by the institutions of the member states ofOSCE in combating illicit trade in human organs;15. Recommends to undertake urgently a comprehensive and independent internationalinvestigation of abductions and crimes, under the safeguard and mandate of theUnited Nations, aimed at the removal and sale of human organs, which had beencommitted in Kosovo and Metohija during the war conflicts in the territory of theFederal Republic of Yugoslavia in 1999 and immediately afterwards and invites toco-operate with UNMIK and EULEX in full, as well as the relevant nationalinstitutions, and in particular to provide all information, facts and documents oncrimes concerning abductions and trade in human organs in the territory of Kosovoand Metohija;16. Supports the activities of the special representative and the co-ordinator of OSCE forcombat against human trafficking andproposesthat OSCE investigates and recordsthe cases of illicit trade in human organs in the area of OSCE with the aim to preparea study indicating the scope of this phenomenon.
