FOR THE GENERAL COMMITTEE ON POLITICAL AFFAIRSAND SECURITY
“RULE OF LAW: COMBATING TRANSNATIONALCRIME AND CORRUPTION”

DRAFT RESOLUTION FOR THE GENERAL COMMITTEE ONPOLITICAL AFFAIRS AND SECURITYRapporteur: Mr. Riccardo Migliori (Italy)
1.Noting that security is indivisible and that, for the States and citizens of the OSCEarea, it resides primarily in ever more co-ordinated political action with respect to organizedcrime and illegal activity in areas of conflict and terrorism;2.Noting that the spread of crime is a real threat to the rule of law and the individualrights of citizens, because it tends to corrupt society, politics, finance and the economy;3.Noting the need to increase the transnational efforts already undertaken to fightorganized crime through greater harmonization among the laws of OSCE participating States,the diversity of which creates “areas of variable legality” that can be easily exploited byinternational organized crime;4.Recognizing the importance of implementing the commitments provided for in theUnited Nations Convention against Transnational Organized Crime (Palermo Convention)and its Protocols and the United Nations Convention against Corruption;5.Noting that the fight against international terrorism is a moral and political necessityinseparable from measures to combat crime, which is often functionally and strategicallylinked to terrorism in all its forms;6.Concerned by the situation in Transdniestria, which, in the absence of internationalrecognition and a transnational presence, not only violates the territorial integrity of theRepublic of Moldova, but threatens to create conditions that foster the rise and growth oforganized crime;7.Considering that the theft and illegal trafficking of works of art and objects ofantiquity, especially in the Mediterranean region, not only constitute deplorable criminalactivities, but represent a genuine affront to the traditions and cultures of that region, one thatcalls for broad civic co-operation between governments and police forces in order to ensurethe rapid restoration of the stolen works to the countries to which they belong;The Parliamentary Assembly of the OSCE:8.Calls on the OSCE participating States that have not yet done so to ratify or accede tothe United Nations Convention against Transnational Organized Crime and its Protocols andthe United Nations Convention against Corruption without further delay, and to give fulleffect to the obligations provided for in those instruments;9.Calls on the Parties to the United Nations Convention against Corruption to regularlyexchange information on their programmes, plans and actions, including legislative andadministrative activities;10.Calls on participating States to take part, at the highest possible level, in the FifthSession of the Conference of the Parties to the United Nations Convention against
-2-Transnational Organized Crime, to be held in Vienna from 18 to 22 October 2010, and hopesthat a verification mechanism for the implementation of the Palermo Convention can befinalized on that occasion;11.Requests its member parliaments to undertake a wide-ranging analysis of the levels ofcorruption in their own public administrations by establishing national anti-corruptionauthorities and specific parliamentary committees;12.Calls on participating States to establish ever more effective forms of regionalco-operation aimed at strengthening legislative and police activities to counter organizedcrime;13.Expresses deep concern over the new and growing phenomenon of internationalpiracy, which threatens global trade by sea and which, despite the zeal and the successes ofthe Atalanta mission, calls for tangible support to be provided to Somalia and sub-SaharanAfrica;14.Calls on OSCE participating States to support the initiatives established by the OSCEfield missions to counter corruption, organized crime and trafficking in human beings and toprovide financial and human resources for that purpose within the framework of a specificmandate;15.Undertakes to solemnly observe, at its fall meeting in Palermo, the tenth anniversaryof the adoption of the United Nations Convention against Organized Crime, while at the sametime honouring the outstanding men and women – politicians, journalists, police officers,magistrates, citizens – who, in Sicily, as in any other OSCE area, lost their lives whiledefending law and democracy from mafias of all kinds.
