Kirkeudvalget har ved brev af 16. november 2006 bedt om kirkeministerens besvarelse af spørgsmål 6 vedrørende L 27, Forslag til lov om ændring af lov om folkekirkens økonomi, lov om menighedsråd, lov om folkekirkens kirkebygninger og kirkegårde og forskellige andre love (Budgetlægning for kirke- og præstegårdskasserne, ændret sammensætning og opgaver for stiftsøvrigheden, aflastning af provsten for administrative opgaver m.v.).

 

”I bemærkningerne til lovforslaget fremgår det, at stiftsøvrighedens opgaver fremover omfatter et juridisk tilsyn med menighedsråd og provstiudvalg, administration af Fællesfonden m.m. Det fremgår endvidere, at direktører har særdeles gode forudsætninger for dette, men uddannelseskravene til fremtidens direktører for de regionale statsforvaltninger sikrer ikke, at disse stillinger besættes med en juridisk kyndig person. Vil den foreslåede model med, at direktøren personligt har opgaven i stiftsøvrigheden, således ikke risikere at blive udhulet inden for få år? Og ville det ikke være mere holdbart generelt at udstyre stiftskontoret med juridisk kompetence?”

 

Svar:

 

Med lovforslagets § 1, nr. 4, foreslås, at stiftsøvrigheden sammensættes, så den fremover består af biskoppen og direktøren for den regionale statsforvaltning, således at hver direktør indgår i stiftsøvrigheden for to stifter. Der stilles ligeledes forslag om, at stiftsøvrighedens opgaver indsnævres.

Med denne indsnævring af opgaverne er det vurderingen, at det vil være overkommeligt for direktørerne for statsforvaltningerne hver at indgå i to stiftsøvrigheder. Denne sammensætning af stiftsøvrigheden vil desuden sikre, at biskoppen har en ”sparringspartner” med økonomiske, juridiske og administrative kompetencer på højest niveau. Det bemærkes i den forbindelse særligt, at statsforvaltningerne varetager det juridiske tilsyn med kommunerne, og direktørerne har således særligt gode forudsætninger for at varetage det tilsvarende tilsyn med menighedsråd og provstiudvalg.

På denne baggrund finder jeg, at direktørerne for statsforvaltningerne fuldt ud har forudsætningerne for at udfylde opgaven på betryggende vis.        

Det skal i øvrigt bemærkes, at der i høringssvarene var meget bred opbakning til denne model. Forslaget nyder således stor opbakning blandt folkekirkens interessenter.
