Mr René van der Linden, President of the Assembly, took the Chair at 3.05 p.m.

 

 

1.         MINUTES

 

The Minutes of Proceedings of the twenty-third sitting were agreed to.

 

2.         ATTENDANCE REGISTER

 

The names of the Representatives, Substitutes and Observers who signed the attendance register are given in the Appendix.

 

3.         ORGANISATION OF DEBATES

 

            On the proposal of the President, the Assembly agreed that the list of questions to Mr Vuk Jeremić, Minister of Foreign Affairs of Serbia and Chairperson of the Committee of Ministers, be interrupted at about 4 p.m.

 

4.         COMMUNICATION FROM THE COMMITTEE OF MINISTERS TO THE PARLIAMENTARY ASSEMBLY PRESENTED BY MR VUK JEREMIĆ, MINISTER FOR FOREIGN AFFAIRS OF SERBIA, CHAIRPERSON OF THE COMMITTEE OF MINISTERS

 

The President welcomed Mr Vuk Jeremić, Minister of Foreign Affairs of Serbia and Chairperson of the Committee of Ministers.

 

Mr Vuk Jeremić addressed the Assembly and presented the Communication on the activities of the Committee of Ministers (Doc. CM/AS(2007)5).

 

Mr Vuk Jeremić replied to questions contained in Doc. 11326 put to him by Mr Jean-Guy Branger, Ms Ganira Pashayeva, Mr Rainder Steenblock, Mr Tony Lloyd.

 

Mr Luc Van den Brande spoke on a point of order.

 

Mr Vuk Jeremić replied to further questions put to him by Mr Tadeusz Iwiński, Mr Luc Van den Brande, Ms Marietta de Pourbaix-Lundin, Mr József Gedei, Mr Tiny Kox, Lord Russell-Johnston.

The President thanked Mr Vuk Jeremić.

5.         HONOURING OF OBLIGATIONS AND COMMITMENTS BY MONACO (DOC. 11299)

 

            The report of the Committee on the Honouring of Obligations and Commitments by Member States of the Council of Europe (Monitoring Committee) (Doc. 11299) was presented by Mr Pedro Agramunt and Mr Leonid Slutsky, Co-Rapporteurs.

 

The debate was opened.

 

Speakers: Mr Bernard Schreiner, Mrs Hanne Severinsen, Mr Leo Platvoet, Mr Erik Jurgens, Mr Jean-Charles Gardetto, Mr Bernard Marquet, Mr Jean-Guy Branger, Mr Gediminas Jakavonis.

 

Mr Pedro Agramunt and Mr Leonid Slutsky, Co-Rapporteurs, and Mr Eduard Lintner, Chairman, Committee on the Honouring of Obligations and Commitments by Member States of the Council of Europe (Monitoring Committee), replied to the debate.

 

The debate was closed.

 

The Assembly proceeded to consider the draft resolution contained in Doc. 11299.

 

An amendment (No. 1) was proposed by Mr Erik Jurgens, Mr Abdülkadir Ateş, Mr Andreas Gross, Mr Pieter Omtzigt, Mrs Corien W A Jonker, Mrs Hanne Severinsen, Mr Christos Pourgourides, Mr Leo Platvoet, Mr Boriss Cilevičs, in the draft resolution, after paragraph 19.1, insert the following sub-paragraph:

 

"put an end to princely practice of providing for criminal offences and penalties by Sovereign Orders without consulting the Parliament;"

The amendment was not agreed to.

 

Another amendment (No. 2) was proposed by Mr Erik Jurgens, Mr Abdülkadir Ateş, Mr Andreas Gross, Mr Pieter Omtzigt, Mrs Corien W A Jonker, Mrs Hanne Severinsen, Mr Christos Pourgourides, Mr Leo Platvoet, Mr Boriss Cilevičs, in the draft resolution, after paragraph 19.1, insert the following sub-paragraph:

 

"demarcate more clearly the cases in which the Prince can issue Sovereign Orders, particularly with regard to incorporating international conventions into domestic law;".

The amendment was not agreed to.

 

Another amendment (No. 3) was proposed by Mr Erik Jurgens, Mr Abdülkadir Ateş, Mr Andreas Gross, Mr Pieter Omtzigt, Mrs Corien W A Jonker, Mrs Hanne Severinsen, Mr Christos Pourgourides, Mr Leo Platvoet, Mr Boriss Cilevičs, in the draft resolution, after paragraph 19.2, insert the following paragraph:

 

"In order to assist the Monegasque authorities in future reforms, the Assembly decides to request an opinion of the Venice Commission on the Constitution and constitutional practice of the Principality of Monaco".

The amendment was not agreed to.

 

Mr Leonid Slutsky spoke on a point of order.

 

The Assembly agreed the draft resolution (Resolution 1566) with 36 votes in favour, 9 votes against and 4 abstentions.

6.         IRAN’S NUCLEAR PROGRAMME: THE NEED FOR AN INTERNATIONAL RESPONSE (DOC. 11294)

 

            The report of the Political Affairs Committee (Doc. 11294) was presented by Mr Göran Lindblad, Rapporteur.

 

The debate was opened.

Mr Serhiy Holovaty, a Vice-President of the Assembly, took the Chair in place of Mr Walter Schmied.
